Good Day Racers,
We have been working hard to get answers to explain what the insurance coverages QSAC have
are and what they do for the track, spectator and racer. QSAC has two different types of policies
and they both provide a different type of protection based on what the scenario is. QSAC has a
General Liability Policy and a Disability/Accident Policy. The bottom line on both of these
policies is this: all QSAC sanctioned tracks and participants at an event, in good standing and
following the sanctioning agreement, are covered by these policies for any club race, series race,
or National event.
QSAC Policies
#1 General Liability: General Liability Policy: This is best described as “spectator liability”
coverage. The policy would respond if the Organization/Member was found legally liable for the
incident/accident/issue. For example, if a car went off the track and injured a spectator the
General Liability policy could potentially respond.
This policy does not replace or provide coverage for the track not directly related to racing or the
event. If a spectator is injured and it's not a result of a member’s activities but a result (for
example) of how the track was constructed, the track could be found liable not QSAC. If the
track is found negligent in this example of construction, the track should have their own General
Liability coverage as well.
What is and isnt negligence by a track during an event or race?
ANSWERS:
NON-NEGLIGENCE: If the rules outlined in the QSAC sanctioning agreement are followed at
the event, QSAC is then the primary insurance covering the track, members and spectators; that
is why we become QSAC sanctioned for the given event/race year.
NEGLIGENCE: an example would be the track allowing a non-member racing or in the hot pit;
no fire extinguishers; or anything not being followed in the QSAC sanctioning agreement. If an
incident happened, the first question asked of the track will be to prove all participants racing or
in the hot pit were QSAC members at the time of the incident. If they are not QSAC members,
QSAC is relieved of all responsibility and provides no coverage to anyone.
Question: Does the liability policy cover the racer if an incident happens, and they were sued?
Answer: The liability policy is simply to cover medical bills from covered injuries and does
extend liability coverage to the racer also. The same limits covering QSAC would cover the
racer.
Please keep in mind, the member does take on some liability when they participate; the QSAC
insurance policy limits just try to mitigate the possible impact. No insurance policy will stop you
from being sued.
#2 Accident/Disability: Accident/Disability Policy:
This policy is for the “members only” and could respond if injury were to occur to a member at a
QSAC event.
Example 1: If a racer is hurt by a part/car/fence or anything at the track are they covered?
NOTE: coverage provided by the accident policy is SECONDARY or Excess to the Primary
Health Insurance of the member.
Answer 1: Injuries to members during events/races are covered.
Example 2: A racer is hurt, but it was not during “competition”, however it was during a QSAC
event at the track.
Answer 2: Yes, that would be an occurrence and if the racer filed a claim, QSAC insurance could
be held liable for the loss.
Example 3: A racer is hurt by a runaway car when marshaling.
Answer 3: Yes, that would be an occurrence and if the racer filed a claim, QSAC insurance could
be held liable for the loss.
Scenario:
Let’s say a member is injured and the cause of injury relates to track events/track
work/participation/etc. The member’s health insurance would respond, however, if they have a
large deductible/co-pays or out of pocket expenses than the accident/disability policy would
come into play and be the “gap” coverage up to a max of $50,000.
